ROLE OF SUBJECT IN DISCOURSE OF DISSENTING OPINION

Abstract. The article analyzes the role of the subject in the discourse of dissenting opinion, which the author considers as an independent legal genre. The purpose of this article is to demonstrate the author’s individual nature of the genre, the subject of which is free to choose the language means of discourse creation. The author argues that the institution of dissenting opinion is an instrument of judicial practice, which allows the judge, who does not agree with the collegial decision, to express his position on the merits.
