Abstract. The author solves the problems of determining the moment and ground of the origin of criminal liability protective relation, basing on philosophical categories determines the phenomenological and noumenological meaning of crime, and uses the obtained conclusions to substantiate the important from the point of view of legal consequences difference of the interconnected categories crime and act that contains all formal components of crime.
