CONTRACT ON FINANCING AGAINST MONETARY CLAIM ASSIGNMENT AND LOAN CONTRACT CORRELATION PROBLEM

Abstract. The author differentiates between the contract on financing against monetary claim assignment and loan contract, analyzes the elements of similarities and differences between these contractual structures, comes to the conclusion that these contracts have considerable similarity in view of general purpose direction, but also have significant differences, condition a variety of economic relations and cannot compete with each other; and basing on the research suggests the amendments to the current legislation to prevent the identification of the mentioned contracts obligations.
