Abstract. The author reveals the problems of ensuring the investigator’s procedural independence during the supervision and control over the legality of the investigator’s decisions after the reformation of the preliminary investigation, tells that having distributed supervising powers between the prosecutor and the investigation agency head, the legislature thus places the investigator in a more dependent position from the head of investigation agency, and pays special attention to the analysis of the criminal procedural legislation norms limiting the investigator’s independence in criminal investigation procedure.
