PENALTY AMOUNT AS ONE OF CRIMES CATEGORIZATION CRITERIA

Abstract. The article is devoted to crimes categorization problem. One of categorization criteria – maximum penalty amount – is studied, legislation changes relating to crimes categories regulation, and different points of view concerning the existing penalty limits for each of the categories are analyzed, the problems of the existing variant of Article 15 of the Criminal Code are revealed, the conclusion about the necessity of criminal law further perfection is substantiated, including by means of ascertaining not only the upper, but also the lower penalty limits for each of crimes categories.
