LEGAL PROCEDURE OF THE KUMYKS IN THE XIX - AT THE BEGINNING OF THE XX CENTURY: NORMS OF ADAT LAW

Abstract. In the article the legal procedure of the Kumyks in the XIX century is considered; the role of Adat Law in it is shown. The introduction of Adat Law into the legal procedure of the Kumyks, who are one of the native Turkic-speaking peoples of Dagestan, is described. Penalty for stealing, murder and robbery that shows clearly the role of customary law in legal penalties is studied. The author for the first time compares customary law with the Muslim-legal tradition by the example of the Kumyk people.
