CRIMINAL-LEGAL QUALIFICATION OF HARM CAUSED AS A RESULT OF ROAD ACCIDENT

Abstract. The article is devoted to the study of the criminal-legal qualification of the incautious damage of somebody else’s property in the context of traffic violation. The research considers the issues related to the activity connected with the sources of increased danger and the resulting peculiarities of the correlation of Articles 264 and 168 of the Criminal Code of the Russian Federation. The analysis of changes in the judicial practice and criminal legislation of the Russian Federation that took place in this field of legal relations from the moment of the adoption of the Criminal Code of the Russian Federation in 1996 till the present moment is conducted, and recommendations on the elimination of the revealed contradictions are worked out.
