PROBLEMS OF APPLICATION OF ANTITRUST LAW TO RELATIONS ASSOCIATED WITH THE USE OF THE RESULTS OF INTELLECTUAL ACTIVITY AND MEANS OF INDIVIDUALIZATION

Abstract. The article by the example of legal relations being established at pharmaceutical market examines the problems of the antimonopoly regulation of the activity of the holders of exclusive rights on the results of intellectual activity and means of individualization. The author describes viewpoints on the advisability of the legal regulation by the norms of antitrust law of relations associated with the use of the objects of intellectual property. The paper also analyzes the experience of foreign countries with the developed system of economy and antitrust regulation, the researcher introduces changes in the national antitrust law aimed to apply antirust legal regulation to the activity of "legal monopolists".
