Abstract.
The author analyzes the struggle against various types of unscrupulous prosecution revealed in the practice of the Roman criminal courts during the period of the Late Republic: calumnia, praevaricatio, tergiversation, considers these crimes as necessary evil under the conditions of the absence of public prosecutors institution in ancient Rome, and comes to the conclusion that Roman legislators certainly undertook the attempts of the struggle against unscrupulous prosecutors but they did not reach their goal.
