DESTINATION OF CRIMINAL PROCEEDINGS: PROBLEMS ASSOCIATED WITH ENSURING HUMAN RIGHTS

Abstract. The article reveals the questions related to the problems associated with the destination of criminal proceedings. It is mentioned that the Criminal Procedural Code does not distinguish between the notions “the purpose of criminal proceedings” and “the destination of criminal proceedings”, does not give a clear definition of the functional tasks of enforcers –agencies and officials, realizing (applying) the norms of substantive and procedural law. The destination of criminal proceedings has a declaratory nature yet, which does nothing for the improvement of human rights and legitimate interests protection in criminal process.
