Abstract.
The article makes an attempt to determine the existence of functional relations between the perforce theory of law origin and the positivistic type of legal consciousness. In the context of the study of the theories on perforce law genesis the conclusion is made about their correlation with legalistic positivism, which traditionally characterizes the Russian legal system. The study of the problems of law origin allows making contribution into the scientific discussion on the issues of the nature, essence and role of law in the development of human civilization.
