Abstract.
The article is devoted to the legal analysis of Paragraph 1, Article 1117 of the Civil Code of the Russian Federation. The notion of unlawful act is considered in the context of the Paragraph and is substantiated by the fact that it can only be a crime. Paragraph 1 of Article 1117 of the Civil Code of the Russian Federation is considered for compliance with the main regulations of criminal law, and the conclusion about insufficiently elaborated legal regulation is made that, as a consequence, may lead to ambiguous interpretation. The drawbacks of Paragraph 1, Article 1117 of the Civil Code of the Russian Federation are revealed in terms of legal technique, and the variants of their elimination are suggested.
