Abstract. In the article the legal status of the Children’s Rights Commissioner in the system of the separation of powers is analyzed. By the example of the Children’s Rights Commissioner in the Republic of Khakassia the authors reveal its special status as a public body of the subject of the Russian Federation, which acts in order to guarantee the rights and legitimate interests of the child in the subject of the Russian Federation. The inexpediency of the adoption of the model law “On the Fundamentals of the Activity of the Children’s Rights Commissioner in the Subject of the Russian Federation” at the federal level is grounded.
