TO THE QUESTION OF THE CRIMINALIZATION OF ABORTIONS IN CRIMINAL LEGISLATION

Abstract. The article deals with the problem of penal punishability for making abortions according to the norms of Russian legislation and the legislations of foreign states. The author tries to specify some contradictions in the formulation of Article 123 of the Criminal Code of the Russian Federation and offers to exclude the given act from penal ones on the basis of the norms analysis of the criminal legislation and the legislation concerning public health in Russian Federation.
