RESTORATION OF POSITION, WHICH EXISTED PRIOR TO RIGHT VIOLATION AS PRINCIPLE OF CIVIL LEGISLATION

Abstract. The article considers the legal nature of the restoration of the position, which existed prior to right violation. On the basis of lexical meaning determination the conceptions of position restoration and the restoration of violated right are compared. Position restoration is associated with the categories of the means of civil rights protection and the principle of civil legislation, as the result of which the appropriation of position restoration to the fundamental principles of civil legislation is substantiated.
