Abstract. The article touches on the issues of the legal status of the parochial clergy of the Russian Orthodox Church of the second half of the XIX - the beginning of the XX century. Imperial legislation involved not only secular issues; it also declared the rights and duties of the clergymen and churchmen. On the basis of archival materials and published sources the author tries to identify the contradictions of church and secular law in the Code of Laws of the Russian Empire, which caused difficulties in the parochial practice of the Orthodox clergymen.
