CONTENT OF CONSTITUTIONAL OBLIGATION IN RESPECT OF OBJECTS OF CULTURAL HERITAGE

Abstract. In the article the content of constitutional obligation in respect of the objects of cultural heritage using classical approach to the content of obligation developed in the theory of law is revealed. According to the given approach the author singles out four components of this obligation: the need to carry out works on the preservation of cultural heritage objects (to refrain from making actions that could harm such objects), the need to provide information about the object of cultural heritage, the need to provide access to such objects, and the need to endure negative consequences in case of the violation of legislation on cultural heritage objects. It is concluded that the clear idea of the content of constitutional obligation to respect cultural heritage objects allows understanding correctly the content standards of branch legislation regulating obligations concerning such objects.
