LAW ORDER AS THE RESULT OF COURT ACTIVITY IN JEROME FRANK'S THEORY

Abstract. The article reveals the view of the American realist of law Jerome Frank on judicial proceeding as the way of struggle for one's rights. The author supposes that legal right appears only after its ajudgment but not after being ascertained by a legislator. In modern states court is the main institute providing law order keeping.
