ABOUT SOME PROBLEMS OF NOTARIZATION OF REAL ESTATE TRANSACTIONS IN THE REPUBLIC OF AZERBAIJAN

Abstract.
The author considers the problems arising during the notarization of the transactions on the alienation or mortgage of dwelling houses, apartments, dachas, garden houses in accordance with the legislation of the Republic of Azerbaijan, comes to the conclusion that such transactions should be certified notarially, with the consent of emancipated minors; considers it expedient to create an electronic information database of emancipated minors in the Ministry of Justice of the Republic of Azerbaijan; mentions the gaps in the legislation, which make it possible for divorced persons to alienate or mortgage property including those acquired during marriage without the consent of former spouse; and tells that an outlived spouse, who acquired property in joint marriage, where one-half share of deceased spouse is not formalized in hereditary order, gets such an opportunity.
