CONTRACT FREEDOM PRINCIPLE FORMATION AND DEVELOPMENT IN THE FEDERAL REPUBLIC OF GERMANY LAW

Abstract. The author researches contract freedom principle formation and development in the German legal culture from the XI th-XII th centuries till modern times, and analyzes the regulations of the German Civil Code as a codified act, which is based on the ideal of freedom that is, according to the creators’ opinion, necessary for the proper functioning of private-law society, which members are entitled to regulate their relations independently, according to their own convictions, without the intervention of state and other third parties.
