Abstract. The problem of necessity to differentiate law into public and private remains debatable, and it is justified by the fact that scientists’ opinions on this issue are determined not only by the legal family, within which they live, but also by the functioning types of the state and law. The article examines sociological and legal approach to the problem of law dualism, provides an analysis of reasonability to differentiate law into private and public from the viewpoint of jurisprudence of interests and the perception of law as a social phenomenon securing the efficient interaction of the state and society.
