INTERNATIONAL TREATIES IN SYSTEM OF CIVIL PROCEDURAL LAW SOURCES

Abstract. The article is devoted to one of scientific and practical problems connected with the sources of civil procedural law, namely: what place the Russian Federation international treaties take in the hierarchy of civil procedural law sources. The existing in science views on the matter are ambiguous and legislative regulation does not give a direct answer to this question. The author concludes that the place of the international treaty in the system of law sources depends on the method of expressing consent to the obligatoriness of this treaty. Furthermore, it is argued that international treaties cannot have priority over the Russian Federation Constitution and federal constitutional laws.
