JUDICIAL PRECEDENT AS THE MAIN LAW SOURCE IN OLIVER HOLMES'S THEORY

Abstract. The article reveals the point of view of the American sociologist of law Oliver Holmes on judicial precedent place in law sources system. Without denying laws importance the scientist emphasized the importance of court lawmaking function which allows it to control legislative and executive branches of power and to harmonize relations in society.
