Abstract. The authors consider the development of the Roman law institution "emphyteusis" in the Russian legal reality, tell that in the history of the Russian civil law until recently (the development of the Civil Code project) this institution was known by other names, with a number of features inherent in them: census use, hereditary quitrent possession, permanent use, lifetime inheritable possession, permanent perpetual use; come to the conclusion that though the institution of hereditary quitrent possession was not eventually put into effect, it still incorporated the best characteristics of emphyteusis, mention that the institutions adopted by the Russian legislator in the sequel and similar to emphyteusis are notable for the features that are typical of the period of their emergence, and prove the identity of the institutions of permanent perpetual use and emphyteusis.
