Abstract. The author covers the problem of the division of legal assistance to individuals and organizations into legal representation and advocacy, studying the theory of the question, recognized scientists-lawyers’ opinions and the Western European countries experience relates the obtained conclusions with the tendencies in the legal space of the modern Russian state, and comes to the opinion about the inexpediency of advocatory monopoly introduction in the Russian Federation.
