RECEPTION OF ROMAN LAW OF PROPERTY IN THE MODERN RUSSIAN CIVIL LEGISLATION

Abstract.
The article provides the historical comparative characteristic of the most frequent both in Roman and Russian law forms of contracts: verbal and literal. Stipulation was the most frequent type of oral (verbal) contract in Ancient Rome. The specificity of modern Russian oral contracts includes the possibility for the person to perform implicative actions. The Roman law developed the following forms of written contracts: records in the account book, syngrapha, chirographa. Analyzing different types of transactions the author identifies the conditions of their invalidation.
