DIALECTICAL INTERACTION OF ARGUMENTATION AND MANIPULATION IN JUDICIAL DISCURSIVE PRACTICES

Abstract. The article deals with the dialectical interaction of argumentation and manipulation in judicial discursive practices. It is noted that manipulation as a method of speech impact on the irrational sphere of consciousness violates logical laws, however, helps to achieve the perlocutionary speech effect faster than logically built-up argumentation, if the addressees are the bearers of naive consciousness. The correlation of argumentation and manipulation in judicial discourse is determined by the intentional state of the speaker, the addressee’s factor and the mode of communication.
