STUDY OF EVIDENCE BY COURT WHILE SPECIFIC JUDICIAL DECISION MAKING (ARTICLE 40 OF CRIMINAL-PROCEDURAL CODE OF THE RUSSIAN FEDERATION)

Abstract. The article considers the issue whether the judge making judicial decision upon the approval of the accused to the charge should investigate and evaluate the evidence. Analyzing the contradictory requirements of the legislation and judicial practice the author concludes that sentence passed in accordance with Article 40 of the Criminal-Procedural Code must be based on the careful evaluation of all the available evidence of the case and the judge’s personal well-grounded conclusion about the guilt of the accused.
