IMPROVEMENT OF MECHANISM OF OVERCOMING CONFLICT OF APPLICANTS’ RIGHTS WHILE FILING APPLICATIONS ON PATENT GRANT

Abstract. In the article the author considers the stipulated by the effective domestic legislation mechanism of overcoming the conflict of applicants’ rights, which arises while filing several applications on the identical objects of patent law or objects with the partially congruent indications of the independent items of formulae. As an optimal resolution of the arising conflicts of applicants’ rights the author suggests a mechanism of the inclusion of unpublished patent applications in the precedent level of technology during the expertise of patent law objects.
