CONSTITUTIONAL-LEGAL AND PROCEDURAL ASPECTS OF DIFFERENTIATING JURISDICTION OF CASES BETWEEN ARBITRATION COURTS AND COURTS OF GENERAL JURISDICTION: THEORETICAL AND PRACTICAL ISSUES

Abstract. The article examines the problems of differentiating the jurisdiction of cases between arbitration courts and courts of general jurisdiction. As a basis for the differentiation the author uses the category of economic dispute, about which there is no transparent conception in the legislation of the Russian Federation. The other criterion chosen by the author is the level of the restriction of the constitutional right of a person to legal assistance in the context of examining by court a case beyond its jurisdiction. The research is relevant in connection with the formation of the integrated Supreme Court of the Russian Federation preserving the system of courts of general jurisdiction and arbitration courts.
